It’s no secret that in Nigeria, electoral offences happen. There’s vote buying, ballot box snatching, bribing of INEC officials, disorderly behavior at a political meeting, illegal voting, threatening a person with violence…these and so much more have been defined as election offenses in our laws and they come with penalties.
Last month, as part of a public hearing on the Bill for an Act to Establish the Electoral Offences Commission 2022 and other related matters, INEC made their case for why we need a separate commission to investigate, arrest, and prosecute election offenders.
We analyze the bill and identify significant gaps that may make the bill ineffective at best, or at worst, a political tool.
